Privacy Policy

Virtual Museum of Art Corporation (VMA) respects the privacy of our online visitors, donors and those who participate in our virtual arts education classes.  We are committed to protecting the privacy and security of the users of our site and related services. 

This privacy policy will advise you about how we protect your personal information. Please read this policy carefully. We may need to change this policy from time to time in order to address new issues and reflect changes on our Site. VMA reserves the right to change the policy at any time, without notice by making an update to this privacy policy on our website at www.VMAlive.org.  All changes will be posted here. If you have any questions or concerns regarding our Privacy Policy or you would like to request Personal Information be removed, please send us an e-mail to lauren@vmalive.org.

By providing a donation to VMA, participating (you or your minor child) in VMA virtual classes, providing VMA testimonials or reviews (written, videos or photographs or telephonically), submitting student created art or content to us (virtually on screen, via a digital file or via hardcopy, before, during or after a class) and/or providing contact information (email, mobile phone), collectively defined as Personal Information, VMA may utilize this Personal Information for class attendance and administration, communication to you and/or your minor child regarding participation in VMA services (whether paid and unpaid). VMA may send individual or group emails, text messages or other forms of communication to you as and/or minor child part of a class or VMA wide distribution group communications to facilitate class scheduling, reminders, assignments, post class summaries of the learning or activities provided by VMA to or other VMA organization updates and information. By participating in any of these aforementioned activities, you agree to terms and conditions of VMA’s Privacy Policy. 

Personal Information


We will not sell, trade, or give out personal information addresses to third party companies or other organizations except as may be necessary for processing credit card, debit card, peer to peer payments (i.e. Venmo) or other forms of electronic donations or payments to VMA. We will not intentionally publicly disclose any personal identifiable information about you as an individual user, such as your full name, street address, telephone number or email address) to any third party without having first received your permission. 

We may request or display certain Personal Information, which may include you and/or your child’s name, email, mobile phone, photograph or video in connection with the use of, or participation in, VMA online classes, through Zoom.us mobile or web applications and in-app chat functions and breakout rooms, in-person field trips, online or mobile chat apps or services, text messaging apps, email, written or video testimonials or reviews or when you make a donation to VMA. However, we will only collect this Personal Information from you if it has been voluntarily submitted to us, including but not limited to providing it to VMA via your participation in our virtual classes, donations to VMA or direct engagement with VMA’s website, social media properties, email and mobile/text of VMA staff and authorized agents.

 

We may record our online learning classes and take screenshots, videos, or digital photographs of VMA classes which may feature you and/or your minor child to improve our educational programming, recognize the art created by our students or to post on our public website at www.vmalive.org or www.virtualmuseumofart.org, to provide an online digital recap of past lessons and to educate students, their parents and prospective students and prospective parents about VMA’s mission, past classes, read reviews (text, photos or videos) and post on our website and social media properties. Any content, artwork, drawing, image, video or likeness of you and/or your minor child, provided to VMA or obtained by VMA through the use of VMA services shall automatically grant VMA, a perpetual, royalty free, worldwide license to use such content without further approval and without compensation. 

 

Any Personal Information provided to us may be used in connection with the activities previously referred to above. Should you send us an email or text message with questions or comments, we may use your Personal Information in order to respond to your questions or comments. We may also keep your comments or questions for future reference.

It is important to note that if you give out Personal Information online (via VMA’s public website, social properties, group texts, group emails, multi-party chat rooms or message boards etc.) that information disclosed publicly may be collected and used by third parties who may operate in the public domain or operate in these public digital or virtual arenas.  Although we strive to protect our users’ privacy, we cannot guarantee the security of information you post in these public arenas. You disclose such information at your own risk. 

VMA may use third-party website extensions and/or third party services on our website for website performance tracking, credit card processing or email outreach. While VMA seeks to work with reputable companies for these services, we cannot guarantee the privacy of your Personal Information if you use these services and they also may be subject to data breaches beyond VMA’s control. 

Please note that VMA will release specific information about you or your account to comply with any valid legal process such as a search warrant, subpoena, statute or court order.

Privacy of Minors

Consistent with the Children’s Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of thirteen (13) without prior verifiable parental consent.

If we become aware that a subscriber is under the age of thirteen (13) and has registered without prior verifiable parental consent, we will remove his or her personally identifiable registration information from our files. Please note that we may nevertheless maintain a record of that person’s name and address in a “do not register” file to avoid subsequent registration by a child under the age of thirteen (13).

Use of Cookies

A cookie is a small data file stored on the user’s hard drive which may contain information about the user. We use cookies but do not store personally identifiable information in your cookie. We may use cookies to help us generate our website usage statistics. If VMA deploys a registered user system, your cookie may allow us to recognize you when you return to our site and provide you with access to your account information. If you make a donation to us, we may use cookies to monitor and maintain information about your use of this Site.

Security of Credit Card Information

VMA’s website utilizes Secure Sockets Layer (SSL), an advanced data encryption system used to ensure the security and confidentiality of information exchanged between your browser and this Site’s e-commerce servers. All of your personal information (including credit card numbers) will be encrypted and then transmitted from your browser to our e-commerce systems securely. This information can only be unencrypted by VMA or its agents. We cannot guarantee secure transactions for orders sent to us via email, mobile text, other third-party apps, Zoom, chat or social media. 

VMA will keep the specific donation amount(s) you make to VMA confidential and shall only be shared with VMA authorized staff, accountants, attorneys or credit card processing companies as may be required, but shall not be publicly shared, unless approved by you.
